1. Agreement and Contractual Relationship

These Terms and Conditions constitute a legally binding agreement under the Indian Contract Act, 1872, between you (the Passenger or Conductor) and Poyaloo Technologies Pvt. Ltd. (incorporation pending, currently represented by Dinexora UG), governing your use of the Poyaloo cashless mobile ticketing platform and applications.

By creating an account, loading money into your wallet, or scanning ticket QR codes, you unconditionally accept these Terms. If you do not agree to these terms, you are prohibited from using the Poyaloo platform.

2. Description of Services & Kerala Transit Coverage

Poyaloo operates a digital scan-and-go ticketing platform. The platform is designed for public bus transit services operating in Kerala under stage carriage permits. Key services include:

  • Poyaloo Wallet: A digital semi-closed PPI prepaid instrument which allows passengers to add funds in Indian Rupees (INR) to pay for bus tickets.
  • QR Code Ticketing: Generation and scanning of journey-specific QR codes on private transit buses and KSRTC carriage buses.
  • GPS Conductor Route Verification: Live location check modules ensuring conductors verify ticketing only within designated Kerala transit schedules.

3. Passenger Conduct and Ticketing Rules

Under the Motor Vehicles Act, 1988 and the Kerala Motor Vehicles Rules, 1989, traveling in a public stage carriage without a valid ticket is an offense. You agree to the following:

  • Mandatory Scan on Boarding: You must scan the conductor's QR code immediately upon boarding a bus. An active internet connection and camera permissions are required to scan successfully.
  • Fare Rates: Ticket fares are calculated and deducted automatically in accordance with the bus fare stages notified by the Government of Kerala.
  • Wallet Balance Maintenance: You must maintain sufficient balance in your Poyaloo wallet to cover the journey fare. If your balance is insufficient, you must pay in cash to the conductor or top up your wallet immediately.
  • Mobile Device: You are solely responsible for ensuring your phone is switched on and functioning. If your phone battery dies mid-journey, you must pay the cash fare or yield to ticket inspectors.

4. Conductor and Bus Operator Rules

Conductors and bus operators using Poyaloo terminals must comply with the following:

  • Valid Licenses: Conductors must hold a valid conductor's license issued by the Kerala Motor Vehicles Department (MVD) and active stage carriage route permits.
  • Route Validation: Conductor terminals must adhere to route verification. Intentional manipulation of GPS positions or routes constitutes a breach of these Terms.

5. Payments, Top-ups, and Refunds

All wallet transactions are conducted in Indian Rupees (INR). Wallet top-ups are completed securely using RBI-approved payment gateways (supporting UPI, Net Banking, and Debit/Credit cards).

Under Reserve Bank of India (RBI) regulations on digital wallets:

  • Wallet balances are non-transferable between users.
  • Manual refunds to bank accounts may be requested by writing to contact@dinexora.de. Standard banking transaction processing fees will be deducted from the refund amount.

6. Limitation of Liability & Disclaimers

Poyaloo acts as a technological facilitator. We are not a transport operator. While we make every effort to verify routes, fares, and schedules, we do not guarantee the operations, safety, or schedules of KSRTC or private stage carriages in Kerala.

To the maximum extent permitted under Indian law, Poyaloo Technologies Pvt. Ltd. shall not be liable for any direct, indirect, incidental, or consequential damages resulting from connection drops, bus breakdown, schedule delay, or server downtime.

7. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of India. Any disputes, claims, or legal actions arising out of these Terms or the use of Poyaloo services shall be subject to the exclusive jurisdiction of the competent courts in Thiruvananthapuram, Kerala, India.
